Ossoff\u2019s bipartisan probe also found the U.S. Department of Justice was failing to implement \u201cDeath in Custody Reporting Act\u201d to track data &amp; help prevent deaths<\/em><\/p>\n\n\n\n<p><strong>Washington, D.C.<\/strong>&nbsp;\u2014 U.S. Senator Jon Ossoff is launching a new inquiry to prevent deaths of incarcerated people in Georgia and nationwide.<\/p>\n\n\n\n<p>Today, Sens. Ossoff and Reverend Raphael Warnock&nbsp;<a href=\"https:\/\/www.ossoff.senate.gov\/wp-content\/uploads\/2024\/06\/24.06.26_DCRA-Reporting-Letter-signed.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">launched an inquiry<\/a>&nbsp;with Attorney General Merrick Garland urging the U.S. Department of Justice (DOJ) to strengthen policies aimed at tracking and collecting data about deaths in Federal, state, and local custody in order to better understand and mitigate risks inmates face while incarcerated.<\/p>\n\n\n\n<p>As part of their new inquiry, Sens. Ossoff and Rev. Warnock requested the Attorney General take steps to update reporting practices under the<em>&nbsp;Death in Custody Reporting Act<\/em>, a law requiring the DOJ to collect data from states and localities about the deaths of inmates in their custody to ensure transparency and help the Department identify potential violations of civil or human rights.<\/p>\n\n\n\n<p>In 2022, Sen. Ossoff led a&nbsp;<a href=\"https:\/\/www.11alive.com\/article\/news\/politics\/jon-ossoff-senate-permanent-subcommittee-investigations-prison-deaths\/85-1d08e40c-ddba-4a8d-ad55-6eb386ecc81c\" target=\"_blank\" rel=\"noreferrer noopener\">10-month bipartisan investigation<\/a>&nbsp;that uncovered the DOJ failed to count nearly 1,000 deaths in state and local custody in 2021 alone, despite those deaths being publicly reported elsewhere.<\/p>\n\n\n\n<p>\u201cIn prior outreach, we have urged the Department of Justice to investigate ongoing disturbing reports of deaths in custody in Georgia\u2019s Clayton County and Fulton County Jails. Tragically, deaths have continued\u2014in just the first six months of 2024, at least six individuals have died in custody in Clayton County Jail. Another three have died in custody in the Fulton County Jail this year, following the death of 10 individuals in custody in Fulton County in 2023,\u201d&nbsp;<strong>Sens. Ossoff and Rev. Warnock wrote.<\/strong>&nbsp;\u201cThese alarming numbers underscore the necessity of stronger reporting under the&nbsp;<em>Death in Custody Reporting Act<\/em>&nbsp;(DCRA) to help identify the causes of these deaths and possible interventions to prevent future tragedies.\u201d<\/p>\n\n\n\n<p>\u201cWhile DOJ has taken steps to improve compliance with DCRA\u2019s reporting requirements, there is still more to be done to ensure that every death in custody is reported fully and accurately\u2014and that the government has the information necessary to identify and address any possible causes of death within its control,\u201d<strong>&nbsp;the Senators continued.<\/strong><\/p>\n\n\n\n<p>In September 2022, a U.S. Government Accountability Office&nbsp;<a href=\"https:\/\/www.gao.gov\/products\/gao-22-106033\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a>&nbsp;found that 70% of records on deaths in custody that states submitted in fiscal year (FY) 2021 were missing at least one category of information DCRA required DOJ to collect.<\/p>\n\n\n\n<p>Earlier this year,&nbsp;<a href=\"https:\/\/www.npr.org\/2024\/01\/02\/1219667393\/there-is-little-scrutiny-of-natural-deaths-behind-bars\" target=\"_blank\" rel=\"noreferrer noopener\">an investigative report from NPR<\/a>&nbsp;found some deaths classified as \u201cnatural\u201d may trace back to preventable factors, such as inadequate medical treatment, neglect, or poor conditions.<\/p>\n\n\n\n<p>However, according to DOJ documents, reporting forms do not call for information about medical treatment or other factors that could shed more light on the causes of \u201cnatural\u201d deaths, making it harder to discern the scope of this problem from DCRA data.<\/p>\n\n\n\n<p>Sen. Ossoff continues working to strengthen public safety and improve oversight of Federal agencies.<\/p>\n\n\n\n<p>In May, Sen. Ossoff\u2019s&nbsp;bipartisan&nbsp;<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/1401?q=%7B%22search%22%3A%5B%22ossoff%22%5D%7D&amp;s=1&amp;r=18\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Federal Prison Oversight Act<\/em><\/a>&nbsp;passed the U.S. House to establish new, independent oversight of the Federal Bureau of&nbsp;Prisons (BOP).<\/p>\n\n\n\n<p>In April,&nbsp;Sens. Ossoff and Chuck Grassley (R-IA)&nbsp;<a href=\"https:\/\/www.ossoff.senate.gov\/es\/press-releases\/sens-ossoff-grassley-introduce-bipartisan-bill-to-crack-down-on-contraband-in-federal-prisons\/\" target=\"_blank\" rel=\"noreferrer noopener\">introduced<\/a>&nbsp;<em>The Lieutenant Osvaldo Albarati Stopping&nbsp;<\/em><em>Prison<\/em><em>&nbsp;Contraband Act<\/em>&nbsp;to crack down on the smuggling of contraband cellphones into Federal&nbsp;prisons by upgrading the charge of smuggling of contraband cellphone into a Federal&nbsp;prison&nbsp;from a misdemeanor offense to a felony.<\/p>\n\n\n\n<p>Earlier this year, Sen. Ossoff&nbsp;<a href=\"https:\/\/www.ossoff.senate.gov\/es\/press-releases\/sen-ossoff-launches-inquiry-into-causes-of-deaths-in-federal-custody\/#:~:text=Ossoff's%20bipartisan%20probe%20found%20the,of%20civil%20or%20human%20rights.\" target=\"_blank\" rel=\"noreferrer noopener\">launched an inquiry<\/a>&nbsp;with the U.S. Government Accountability Office (GAO) into how the U.S. Department of Justice (DOJ) determines and reports the cause of death for people who have died in Federal custody.<\/p>\n\n\n\n<p>In February, Sen. Ossoff&nbsp;<a href=\"https:\/\/www.ossoff.senate.gov\/es\/press-releases\/watch-sen-ossoff-presses-federal-prisons-director-to-stop-flow-of-contraband-at-u-s-penitentiary-atlanta\/\" target=\"_blank\" rel=\"noreferrer noopener\">pressed<\/a>&nbsp;BOP Director Colette Peters in a U.S. Senate Judiciary Committee Hearing on the steps she\u2019s taking to crack down on the contraband flowing through BOP facilities that threaten public safety, including at U.S. Penitentiary Atlanta.<\/p>\n\n\n\n<p>In December 2022, Sen. Ossoff\u2019s bipartisan&nbsp;<em>Prison<\/em><em>&nbsp;Camera Reform Act&nbsp;<\/em>was&nbsp;<a href=\"https:\/\/www.ossoff.senate.gov\/es\/press-releases\/sen-ossoffs-bipartisan-bill-to-strengthen-security-at-federal-prisons-becomes-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">signed into law<\/a>, requiring the Federal Bureau of&nbsp;Prisons to upgrade outdated and broken security camera systems, ensuring all facilities have the coverage necessary to protect the safety of incarcerated people and staff.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.ossoff.senate.gov\/wp-content\/uploads\/2024\/06\/24.06.26_DCRA-Reporting-Letter-signed.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Click here<\/a>&nbsp;to read Sens.
